Pedestrian Accidents in Kansas

Pedestrian accidents are an unfortunate and common occurrence in cities across Kansas. While drivers are expected to be cautious around pedestrians, accidents still happen when drivers fail to yield the right-of-way, speed, or are distracted. The results of these accidents can be devastating, especially when pedestrians are struck by moving vehicles.

Some of the most common reasons pedestrian accidents happen include:

  • Distracted driving – Drivers who are texting, talking on the phone, or engaging with in-car technology are less likely to notice pedestrians crossing the street.
  • Failure to yield to pedestrians – Some drivers fail to stop at crosswalks or do not give pedestrians the right of way, increasing the chances of accidents.
  • Speeding – Excessive speed reduces a driver’s reaction time, making it harder to stop quickly when a pedestrian steps into the roadway.
  • Poor visibility – In low light conditions, such as early mornings or evenings, pedestrians may not be as visible to drivers, especially if they are wearing dark clothing.
  • Impaired driving – Alcohol or drugs can significantly impair a driver’s ability to react quickly and follow traffic rules, increasing the likelihood of accidents.

In cases where a pedestrian is injured, the consequences can include significant medical bills, emotional trauma, and lost wages from time off work.

Pedestrian accidents tend to result in more severe injuries than typical car crashes due to the lack of protection for pedestrians. Common injuries in pedestrian accidents include broken bones, head trauma, spinal injuries, and even fatalities.

When a pedestrian is injured, they may be entitled to compensation for their medical expenses, pain and suffering, lost wages, and future treatment costs. Filing a personal injury claim with the help of a personal injury lawyer can ensure that victims receive the support they need.

In some cases, the claim may be made against the driver’s insurance company or through a lawsuit if negligence is involved.

Kansas law holds drivers accountable for the safety of pedestrians. If a driver’s carelessness or reckless behavior leads to injuries, the victim may be entitled to compensation. Legal action can also help prevent similar accidents from occurring in the future by holding responsible parties accountable for their actions.
