Losing a loved one in a fatal car crash is an unimaginable tragedy that leaves families devastated. The emotional toll, combined with the financial impact, can make it feel impossible to move forward. During this difficult time, it’s essential to know that you may have the right to pursue justice on behalf of your loved one. Filing a wrongful death claim can provide compensation that can ease the financial burden and hold those responsible accountable for their actions.
Missouri adheres to a legal principle known as “pure comparative negligence,” which affects wrongful death claims. Under this rule, even if your loved one was partially at fault for the accident, your family can still recover compensation. Damages, however, are adjusted based on the degree of fault attributed. This means if the deceased was found to be 99% at fault, compensation can still be awarded for the remaining 1%.
