How Long Do Victims Have to File a Claim After a Pedestrian Accident in Missouri?Pedestrian Struck and Injured by Vehicle at Panther Creek Rd

In Missouri, victims of pedestrian accidents have a limited amount of time to file a personal injury claim. The state’s statute of limitations for personal injury claims, including pedestrian accidents, is generally five years from the date of the incident.

This means that if you’ve been injured in a pedestrian accident, you typically have up to five years to file a claim seeking compensation for your injuries. However, it’s crucial to remember that the clock starts ticking from the day of the accident itself, so acting promptly is always recommended.

If the pedestrian accident leads to the victim’s death, Missouri law allows the family members of the deceased to file a wrongful death claim. Like personal injury claims, wrongful death claims in Missouri must be filed within three years of the victim’s death, so it’s essential to consult an attorney as soon as possible to ensure that all deadlines are met.

It’s worth noting that while the statute of limitations for personal injury claims may allow up to five years, it is often in the victim’s best interest to file the claim as soon as possible. Starting the process early allows victims to gather necessary evidence, seek medical treatment, and properly document the incident.

It also allows the lawyer more time to negotiate with insurance companies, gather witness testimony, and potentially avoid any delays that could arise as time passes.

Some injuries from pedestrian accidents may not be immediately apparent. Some individuals may not notice pain or injury until days or weeks after the accident. Filing a claim sooner rather than later can ensure that you don’t miss out on seeking compensation for injuries that might develop later.

For those injured in a pedestrian accident, contacting a personal injury lawyer can help ensure that your case is handled within the required time frame and that all necessary steps are taken to pursue compensation. An experienced lawyer can help you understand what type of claim you may need to file, whether it’s a personal injury claim or a wrongful death claim, and explain the steps involved.
